These terms and conditions govern your use of the Recall The Day website and the enquiry and booking process. They apply before and alongside any Equipment Rental Agreement entered into for a specific booking. By using this website or submitting an enquiry, you accept these terms.

1. Intellectual Property
All content on this website — including text, graphics, logos, images, and audio — is the intellectual property of Recall The Day and is protected by UK copyright law. You may not reproduce, distribute, modify, or sell any content from this website without our prior written consent.
2. Privacy and Personal Data
We are committed to protecting your personal data in accordance with UK GDPR and the Data Protection Act 2018. Our Privacy Policy explains what data we collect, how we use it, and your rights. By using this website, you acknowledge that you have read and understood our Privacy Policy.
3. Bookings and Payment
All bookings are subject to availability and are not confirmed until a non-refundable Booking Fee has been received. The Booking Fee secures your event date and represents a genuine pre-estimate of the loss we would incur if a booking were cancelled, including administrative costs and the opportunity cost of holding that date. The balance payment is due in advance of your event in accordance with the timescales set out in your Equipment Rental Agreement.
Full payment terms, cancellation provisions, and your statutory rights in relation to the booking are set out in the Equipment Rental Agreement provided at the time of booking.
4. The Service
Recall The Day provides vintage audio guestbook equipment for hire at events. The specific terms of each hire — including delivery, return, permitted use, and condition requirements — are governed by the Equipment Rental Agreement signed at the time of booking, which takes precedence over these general terms in the event of any conflict.
While we take every care to represent our equipment accurately, the appearance of items shown on this website may vary slightly from those supplied.
5. Audio Recordings
Audio recordings made using our guestbook equipment are the property of the client (event organiser). We store recordings temporarily to enable delivery and may use approved audio processing tools solely to enhance recording quality before delivery. We do not use recordings for marketing, training, or any other purpose without prior written consent.
As the event organiser, you are responsible for informing your guests that audio recordings may be made at your event. Full details of how we handle recordings — including retention periods and your rights — are set out in our Privacy Policy and your Equipment Rental Agreement.
6. Limitation of Liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law, including under the Consumer Rights Act 2015.
Subject to the above, our total liability to you in connection with the use of this website or any pre-contractual enquiry shall not exceed £100. Liability in connection with a confirmed booking is governed by the Equipment Rental Agreement, which contains its own limitation of liability clause.
We are not liable for any loss or damage arising from your use of third-party websites linked from this site.
7. Website Availability
We aim to keep this website available at all times but cannot guarantee uninterrupted access. We reserve the right to modify, suspend, or withdraw the website or any part of it without notice.
8. Governing Law
These terms are governed by the laws of England and Wales. Any disputes arising from your use of this website or a pre-contractual enquiry shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
9. Changes to These Terms
We may update these terms from time to time. The date at the top of this page reflects when they were last revised. Continued use of the website after changes are posted constitutes acceptance of the updated terms.
